This is the privacy policy (“Privacy Policy”) that governs how WeScan LLC d/b/a PourThat, a Delaware limited liability company, and its affiliates (“PourThat“, “we“, “our” or “us“), use, store, and protect Personal Information (defined below) that we collect or receive from you (sometimes defined as “your” or “user”) in connection with the use of our website: https://pourthat.com and any other PourThat-operated website, web-based platform, mobile application, or through our offered products or software that process, store, or use Personal Information (collectively, the “Services”).

You may choose whether or not to provide or disclose Personal Information in connection with your use of the Services. If you choose not to provide the Personal Information we request, you may be unable to access or use certain areas of the Services. The Services may contain links to third-party websites and services that are not owned or controlled by PourThat. We are not responsible for the privacy practices or the content of third party websites, services and advertisements, and you visit them at your own risk.

After you read this Privacy Policy, please read our Terms of Service (“Terms”). This Privacy Policy and our Terms work in conjunction. In the event any terms in this Privacy Policy conflict with the Terms, the Terms shall control.

1. Introduction

We are committed to respecting privacy and recognize the need for appropriate protection and management of any Personal Information that we collect through your use of or in connection with the Services. As used in this Privacy Policy, “Personal Information” is information that, either alone or in combination with other information, reasonably identifies or relates to a particular individual.

2. Changes to this Privacy Policy

We reserve the right, at our discretion, to change the terms of this Privacy Policy at any time. You can see when this Privacy Policy was last updated by reviewing the “Last Updated” legend on the top of this page. We may provide you with notice of material changes to the Privacy Policy as appropriate under the circumstances. UNLESS OTHERWISE INDICATED, ANY CHANGES TO THIS PRIVACY POLICY WILL APPLY IMMEDIATELY UPON POSTING TO THE SERVICES.

3. Information Collected

We may receive or collect Personal Information in the following ways:

3.1. Personal Information You Provide To Us

Within a few areas of the Services, we may request information from you to make the requested Services available to you. For example, if you request, we contact you by submitting a “Contact Us” request, we may ask you to provide us with certain Personal Information, such as:

  • Your name;
  • Email address;
  • Username;
  • Telephone number;
  • Zip Code;
  • Date of Birth;
  • Profile Photo;

· Login credentials to your account (as described in the Terms);

· Individual food and drink preferences;

  • Social media network associations;
  • Internet Protocol (“IP”) address; and
  • Location.

PourThat processes, stores and uses all Personal Information received from a Client in accordance with all applicable laws, statutes, rules, regulations, orders, decisions, interpretations, opinions, industry self-regulatory principles and guidelines, and other requirements, whether promulgated by the United States or any other applicable jurisdiction. 3.2. Personal Information We Automatically Collect

When you use or access the Services, we use cookies, device identifiers, and similar technologies such as pixels, web beacons, and local storage to collect information about your use of the Services.

A. Cookies

Cookies are small data files that are transferred to your computer’s hard disk and are used to store information about website visits, preferences, order history and order preferences, and enhances website functionality.

When you access or use the Services, our servers may send a cookie to your computer. Standing alone cookies do not personally identify you; they merely recognize your web browser. Unless you choose to identify yourself to us, either by responding to a promotional offer, opening an account, or filling out a web form, you remain anonymous to us. We may also use cookies that are session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer.

Some of our third party service providers and partners may use cookies or other methods to gather information regarding your use of the Services. Such service providers and partners may use these cookies or other tracking methods for their own purposes by relating information about your use of the Services with any of your Personal Information that they may have. The use of such information by a third party depends on the privacy policy of that third party.

B. Log Files On The Services

When you use the Services, our servers may automatically record information, including IP addresses, type of browser, Internet Service Provider (“ISP”), date/time stamp, referring/exit pages, clicked pages and any other information your browser may send to us (collectively “Log File Information”). We use Log File Information to help secure the Services by identifying potential threats and vulnerabilities and improve the Service’s function and content.

C. Other Tracking Technologies

We may also use web beacons alone or in conjunction with cookies to compile information about your usage of the Services and interaction with emails from us. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular site tied to the web beacon. For example, we may place web beacons in marketing emails that notify us when you click on a link in the email that directs you to the Services. We may use web beacons to operate and improve the Services and email communications.

D. Advertising

We may engage third parties, including social media platforms, who may use cookies, pixel tags, and other storage technologies to collect or receive information from the Services and elsewhere on the internet to provide marketing services to us, including targeted advertising. 4. The Purposes For Which We Use Personal Information

If you submit or we collect Personal Information through the Services, then such Personal Information may be used in the following ways: (i) to provide, analyze, administer, and improve the Services, (ii) to contact you in connection with the Services, notifications, events, programs or offerings that you may have registered for, (iii) to send you updates and promotional materials that you have registered for, (iv) for direct marketing or advertising purposes, (v) to identify and authenticate your access to the parts of the Services that you are authorized to access; (vi) to verify your identity, age, or for some other verification purpose in connection with the Services and as requested by our you, and (vii) to protect our rights and/or our property and to ensure the technical functionality and security of the Services.

5. How We Disclose Personal Information

We do not disclose Personal Information collected through the Services except as set forth in this Privacy Policy and with your consent. By using the Services, you expressly agree, without limitation, that we may disclose your Personal Information in the following cases:

5.1. Our Service Providers. We transfer Personal Information to our third party service providers to perform tasks on our behalf and to assist us in providing the Services. For example, we may disclose your Personal Information to our third party service providers for our direct marketing or advertising purposes. Such information may be transferred to other countries around the world. We take commercially reasonable steps to help ensure our third party service providers provide at least the same level of protection for Personal Information as we do. Notwithstanding the foregoing, we will comply with applicable laws regarding Personal Information transfers as well as any transfer restriction that is specified in an agreement between us and a customer.

5.2 Business Partners. From time to time, we may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from us, we may share Personal Information collected in connection with your purchase or expression of interest with our joint promotion partner(s). We do not control our business partners’ use of Personal Information we collect, and their use of the information will be in accordance with their own privacy policies.

5.3. Affiliates: We may transfer Personal Information to our subsidiaries and affiliated companies (each an “Affiliate”), but only for the purpose of providing the Services. We require our Affiliates to process any such Personal Information in compliance with this Privacy Policy. Notwithstanding the foregoing, we will comply with applicable laws regarding Personal Information transfers as well as any transfer restriction that is specified in an agreement between us and a customer.

5.4. In the Event of Merger, Sale, or Change of Control. If we sell or otherwise transfer part or the whole of our business or assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution or liquidation), any information collected through the Services, including Personal Information, may be among the items sold or transferred.

5.5 Third Party Individuals. To the extent you have enabled location-based services, we may share Personal Information with one or more third party individuals (within your authorized social media network or who are otherwise connected to your profile) information about your current location and individual food and drink selections and preferences. We may also share this information with restaurant establishments that we are partnered with. We share this information, to the extent you have consented to such sharing, for the purpose of providing information to your contacts and our business partners about your location-based food and drink preferences. If you wish to not share this information, we provide tools to limit your location-based tracking and sharing options. You may also limit location-based tracking directly through your web browser or your mobile phone settings.

5.6. Other Disclosures. We may disclose Personal Information about you if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our Terms, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of us, our users, or the public.

6. Retention of Personal Information

We reserve the right to retain any Personal Information as long as the Personal Information is needed to: (i) fulfill the purposes that are described in Section 4 (The Purposes For Which We Use Personal Information), (ii) comply with applicable law; or (iii) satisfying any legal, regulatory, accounting, or reporting requirements.

It is our policy to retain your Personal Information while your account (as described in the Terms) is active. Once you deactivate your account, we will take reasonable efforts to make sure your account is no longer viewable on the Services. After your account is inactive for an extended period of time, we may delete Personal Information associated with your account, unless: applicable laws require us to keep information, to evidence our compliance with applicable laws, your information is relevant to an outstanding claim or dispute, or the information must be kept for our legitimate business interests (e.g. fraud prevention or enhancing the security and safety of the Services).

7. Data Security

The security of Personal Information is important to us. We follow generally accepted industry standards to protect the Personal Information collected through the Services, including, but not limited to, industry-standard encryption technology. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect Personal Information, we cannot guarantee its absolute security.

8. Children’s Privacy

The Services are not intended for children under the age of 13. We do not ever knowingly collect or solicit Personal Information from children under the age of 13. If you are under 13, please do not send any Personal Information about yourself to us through the Services.

9. How We Respond to Do Not Track Signals

At this time, PourThat is unable to universally respond to “Do Not Track” or other “opt-out” mechanisms that have been activated by a user through their web browser, and except as otherwise provided herein, does not alter its policies if a user activates such mechanism.

10. State-Based Rights

Laws in California and other states give users in the state certain rights regarding the control of Personal Information. Under applicable law, if we disclose or share your Personal Information, collected through the Services, with third parties for our direct marketing or advertising purposes, you may, once per calendar year, request we provide you certain information regarding the disclosure of your Personal Information, including: 1) the identity of the third parties we disclosed your Personal Information to; 2) the categories of Personal Information we disclosed; and 3) the mailing addresses for the third parties to whom we disclosed your Personal Information. To request the above information or to request any other actions regarding your Personal Information, please contact us using the information outlined in Section 11 (Contact Us) below. Please allow thirty (30) days for a response.
